“Learning to Recognize Risk: A Case Study” 

This hands-on workshop will explore defective construction claims against contractors, design professionals and others, with a particular focus on insurance coverage and defense strategies. This case study will draw on the presenters’ real life experiences in handling litigation on behalf of Design Professionals. Questions and input will be entertained from the audience and discussion of the standards of the profession will also occur to provide a forum for the exchange of ideas on ethical issues, insurance, litigation and risk management. 

Attendees will learn to: 

  • Identify and apply strategies to defend defective construction claims.

  • Identify insurance coverage issues and solve them.

  • Understand the difference between professional liability and general liability policies.

  • Evaluate the role of other defendants and additional insured/indemnity issues.

Presenters


John P. O'Malley, Esq. is one of the founding partners of the law firm of Crisham & Kubes, Ltd.   His practice includes all areas of complex commercial litigation, and insurance coverage litigation.  His insurance coverage litigation practice focuses primarily on the representation of insurance companies and their insureds in the context of general liability, project policies, and professional liability policies.  Mr. O'Malley has taught Trial Advocacy and related skills as well as courses in insurance law to students and insurance industry professionals.  Mr. O'Malley received his J.D. degree with Honors from The DePaul University College of Law, and his B.S. degree from Marquette University.   

 

Melissa Roberts, AAI, Vice President - Melissa has been with Euclid Insurance in Itasca, Illinois since 1984 where she helps design firms avoid claims, manage their risks and purchase Professional Liability insurance.  She has served as President of a/e ProNet - a national organization of Architects and Engineers Professional Liability brokers. Her recent article, “Reporting Claims and Potential Claims Under Professional Liability Insurance” was published by AIArchitect and is included in AIA's new Best Practice feature along with her previous article, “Changing Professional Liability Insurance Providers”. 

 

Jeffrey T. Kubes, Esq. is one of the founding partners of the law firm of Crisham & Kubes, Ltd.  Mr. Kubes has primarily concentrated his practice in the representation of architects, engineers and other design professionals in a wide variety of disputes and claims in alternative dispute resolution and litigation settings.  Since 1990, Mr. Kubes has taught trial advocacy and related skills to law students and practicing attorneys through various organizations. He has authored several articles and is a frequent presenter on topics related to design professional liability and construction law.
